On Friday October 13th, 2006,
the United States put into law the Unlawful
Internet Gambling Enforcement Act. This act
attempts to stop Americans from playing online
poker by making it illegal for financial
institutions, such as banks and credit card
companies, to allow deposits to be made into any
gambling website.
This act has caused several major Internet poker rooms (PartyPoker, ParadisePoker, PacificPoker, PokerRoom, TitanPoker, MansionPoker, DoylesRoom, EmpirePoker, NoblePoker...) to no longer accept US citizens. Most of these poker rooms were owned by publically traded companies strongly influenced by American investors. Fortunately, many major online poker websites have chosen to continue to
accept American players. They can do this,
firstly, because poker is a game of skill and not
strictly a form of gambling, and secondly, because
they operate in jurisdictions outside of the
United States.

only lists Internet poker rooms that still accept
US players. This guide is vital to any

In early October the Federal Reserve as well as Department of Treasury released their joint proposal for rules to implement for the Unlawful Internet Gaming Enforcement Act. While the proposed rules clarify some of the enforcement requirements for the UIGEA, those looking for black and white answers may be left extremely confused after reading the massive 52 page document. Industry experts have examined the document and find it to be extremely vague and full of holes - it is looking like the Bush government screwed this thing up big time and it will never have a major effect on Internet gambling! Also in October, a Brussels based legal team has accused the US government of reneging on commitments made to the World Trade Organisation (WTO) over Internet gaming. Lately there has been harsh criticism again the USA's rediculous war on Internet gaming and many believe that the US could be liable for up to US$100 billion in trade concessions to European industries after placing illegal and absurd discriminatory trade restrictions on European online poker operators.
I requested a cashout from Golden Palace Poker in FEBUARY right after they banned US players! They keep jerking me around, finally they paid me. In the mean time I have been using Visa Gift cards to deposit at online poker rooms such as Full Tilt! Walgreen's here started selling them again after about a 2 month hiatus, picked a $100 one up tonight and deposited to pstars with it in seconds. Good news. Neteller cashouts to Bank of America?
I've already heard that after Online Pocker being slapped with tons of fines, Bank Of America has stopped sending money out to neteller accounts. In addition I've heard they are about to freeze out epassporte with the recent influx of deposits.
My question, has anyone received an EFT cashout from neteller to Bank of America lately? I have one in que and am wondering if I should just cancel the cashout and do poker for Americans via the neteller ATM card instead - especially if BofA is just going to decline the cashout anyway!

3. So what is the deal now? Is poker banned or not? Prohibition doesn’t work
People are still playing online poker and we are in somewhat of a grace period. The US government has 270 days from the time the bill was signed (Oct 13, 2006) to issue requirements for US banks poker for usa payment providers. Places like Neteller have already stopped serving US gambling transactions after their 2 co-founders were arrested.

In my opinion the U.S. government will not allow another processor to simply just step in and replace Neteller. They will pursue the owners of these companies just like they did the guys at Neteller.

What business person in their right mind would want to form a start-up right now specifically to handle payment processing for online gambling sites and U.S. citizens? That's like guaranteeing yourself an indictment.
I certainly hope one of Online Poker Reviews these companies can seamlessly replace Neteller, I really do, but I just don't see the long term sustainability of any payment processor in this industry that openly processes U.S. citizens money into gaming sites.
The reality is that we can keep our fingers crossed, but as affiliates or even players for that matter we better mentally prepare and have a contingency plan in the event that there is an all out prohibition.
Share your thoughts on where you see the industry in 6 months poker rooms allowing Americans
I've been cashout out regularly from Party to my TD VISA US currency card since Jan. I did it about 4 times for at 5K each and each time the 5 K would show up as a positive balance when I check with online banking. Once it shows up, I would call VISA and request a cheque or a transfer to my main bank acct. 2 weeks ago , I made another cash out for a little over 5K and the money showed up again as a positive balance so I call VISA and request a transfer. A week or so later, it still doesn't show up in my bank acct so I call them and they tell me to wait 2 business days. Then a couple of hours after getting off the phone, I get a call from VISA saying that the money will not be transfered because it was obtained from online gambling. She says I can make purchases on the card or go to my bank and ask for cash advance but she won't make the transfer. So this morning I go to TD and ask for cash advance, bank teller didn't know what to do so she calls VISA and then after 15 min she comes back and asks me where the money was from. I tell her from online gambling and she gets back on the phone and then after another few minutes, she tells me to call VISA in aweek because they are looking into things because the money is from online gambling. AFAIK, there is no law against financial institutions completing transactions with online gambling sites. Am I wrong? I mean, I'm pretty sure that I could still make a deposit using the credit card if I wanted to and if so, how can they accept the deposit but refuse giving me my money? In order to cash out from Bodog they want a form saying I'm not going to charge back to my card, about 15 sorts of ID, a rubbing of my credit card (?) and so on. So far, so standard (if more than most places).
However, they will apparently only accept this via fax, not emailed scans, allegedly for 'security'. Given that this involves sending a huge multi page fax to an international number (I'm not in the States), this is going to cost lots of money (for me...). I'm therefore not particularly happy about this, given it seems to be them justing making life as difficult as possible for no good reason.
I've asked about sending scans and have received contradictory answers from their CS. Has anyone here had any luck in this area?
Doyles Room no longer accepts USA poker players.
We have discussed in past months the fact that the individual states are able to license and regulate online poker within their boundaries, as long poker for Americans they bar residents of other states from playing. And that this wasn't a right granted to them by the UIGEA, but rather Online Pokr one that they possessed which the federal government even under its broadly interpreted Commerce Clause authority, couldn't take away. The UIGEA only made poker for Americans clear that the states or Indian reservations could not allow non-residents to play on such a state/reservation platform.
So for example, the state of New York can license and regulate and thus legalize online poker for its residents. poker for Americans presumably can even do so in a monopolistic fashion as is done with lotteries. And it could presumably license an existing online site like party poker to do so, though possibly they would have to maintain their servers for same within state boundaries. Of course except for the largest states, the player pools might not be very attractive in size for a single state, though perhaps that wouldn't be true even in smaller ones if online poker was totally legal. Nonetheless, poker room accepting Americans is a consideration and likely shortcoming.
Not back to those lotteries. We all know that there are multi-state lotto pools, often (always?) apparently the result of interstate compacts, and which compacts like all such ones apparently needing to be given the assent of congress (is that correct?). So the question is can the states form a compact and run multi-state online poker sites, where the licensed entity running same Play Poker like a Pro basically gives rakeback to the participating states on a proportional basis? And would the UIGEA need to be modified in order to do so, or would congress ratifying such a compact overide any such considerations?

Title says it all, what's the legality of being an affliate for a poker room or any gambling site after the bill? I remember some type of language in the bill going something like "In the business of accepting wagers..." or something to that effect, and not Evrest Poker sure if that would include affliates or not. I mean, aflliates are by definiton, affliated with those businesses.

Have a decent amount in sportsbook.com and want to cash about 3/4 of it out. I just read the entire WSEX v. Sportsbook.com thread and it alluded to slow cashouts and one post said that no one has been able to cash out recently. Can anyone verify this? Has anyone has success recently getting money off of sportsbook.com? Is this the best method of poker for Canadians now that Neteller does not allow Canadians?
I'm in the US so Neteller is out.
Please post experiences, good or bad, about cashing out of sportsbook.com in the past couple months.

I've seen this question asked a few times now since the bill passed. I have yet to see a straight answer from somebody that really knew what they were talking about but I did hear from a few credible sources that they believed that if you were a US citizen promoting non-US sites, then that wasn't illegal since you aren't really breaking any laws (you aren't servicing Americans and you aren't breaking any laws of the country the site is located in).
Personally, I wouldn't worry about it until you started hearing of affiliates getting arrested. To my knowledge, there hasn't been any poker affiliates arrested to date.
We'll see....
Thus again using party poker Casino For Americans as the licened primary site, and assuming the above was legal, a group of many or indeed all states licenses party poker to conduct online poker within the US, thus barring foreign players (since the gov't likes to ignore WTO considerations we will too for this example). But in order to foster competition, which domestic gaming companies would no doubt demand, a skin system is implemented. Any licensed gaming company like Harrahs could operate a skin through the primary licensee who ran the whole thing. And of course if the primary licensee didn't do a good job, they could be replaced by a skin, who then became the primary licensee.
DoylesRoom no longer allows USA players. I repeat, DoylesRoom.com no longer allows American residents or USA citizens. Turkey has been trying really hard to become a member of the European Union, and with more countries in Europe legalizing online gambling, this will not help them at all, especially while the European Trade Commission is really pushing hard for E.U. wide legalizing of online gambling sites. This also could be seen as a move by the religious part of the country to enforce "spiritual laws" into the everyday life of the citizens, as the Koran prohibits gambling in all forms.
As many of you know, some posters don't appreciate my efforts to keep the focus on the shortcomings of the PPA until they, *as promised*, come back here to discuss same with us. After reviewing the financials of the PPA poker room accepting Americans becomes very clear that they in no way have the money they need to win the battle they are fighting. The first question that popped into my mind was why the big pokersites-- Stars, Tilt, UB & Bodog-- have not given huge financial donations(in the millions) to the PPA. Afterall the PPA is fighting to keep the extremely lucratve US market open for them and the sites themselves are cash rich racking in hundreds of thousands a day. I could only come up with two answers that made any sense: 1. The sites know it is a losing battle so why throw a load of money into a fight that cannot be won, and 2. The sites do not trust the PPA. I think either one of these makes sense or perhaps poker room allowing Americans is a combination of the two. What do you think?
An EFT is an Electronic Funds Transfer. As the name implies the transfer takes place via electronic means. Funds are transferred between banks via a very regulated and tightly controlled network. All that is needed to completely block EFTmtransactions from gaming sites or to eWallets who deal with gaming sites is to add a single field to the existing electronic interface.

Anyway, I wanted to try to assemble a thread that summarizes current US funding options, primarily regarding Stars & Tilt.

Checks : generally the cleanest way to cash out, no fees, 7-20 days.
Visa debit card : you can cash out to payTru or ePassporte and use a visa debit card to make purchases or withdraw from an ATM. There are large fees associated with this but some people may like the convenience.
Wire Transfers : reportedly very slow at the moment

ePassporte : it takes 7-20 days to set up a connection to your bank, but once it's set up transfers are very fast. The fee is 5% . If you get a debit card there's an additional $30 plus other fees.
payTru visa debit : this is the new option Stars is pushing. You can cash in instantly and transfer to stars. Loading is a 4% fee. WARNING : loading from your credit card may also cause a cash advance fee on your credit card depending on your card. If you keep any balance or use it for withdrawals there are lots of other fees; Stars recommends using them only for loading.
MoneyGram : fast option for stars once you go to a MoneyGram location in person. $9.95 flat fee up to $2500 makes this a low-cost option for big loads.
Visa Gift Cards : apparently the "Gift2Go" (aka "IDT") visa gift card available at Walgreens works for loading. The fee is $6 for a $250 card which is 2.4% ; WARNING : purchasing with your credit card may count as a cash advance.
Other VISA/debit cards : some ordinary visa check or debit cards will also work, it's up to the visa issuer whether they refuse or not. Calling your issuer may help. Apparently people have good luck with this using cards from small local banks. Cards tied to a checking account are available for a 0% fee which makes this the very best option if you have it.

I got an e-mail from neteller saying that they were unable to withdraw funds from my bank account (that they had already allowed me to transfer to a poker site). Although I requested the funds be taken from my bank over a week before they closed to US cunstomers, they failed to do poker room allowing Americans in time, and now are trying to get me to send them a money order "ASAP". What can they do if I don't comply? I never agreed to do anything of the sort, and it's their fault for not taking the money from my bank like they had done hundreds of times in the past. Any idea what they can do legally? I would call them and assure them that their money is safe and they can access their money through available withdrawal options. I would then inform them that unfortunately EFT are on hold at this time and that ATM cards cannot be loaded but their money is safe and they can withdraw when more options are available. 5. Why are some states not accepted at certain online casinos poker for usa poker rooms?
